The appearance of a brand on our site is intended to identify products that we can manage or acquire for our customers.

9. No Implied Affiliation

The use of a trademark, trade name or logo on DATEN Global should not be interpreted as a statement that:

  • the manufacturer sponsors DATEN;
  • the manufacturer endorses DATEN;
  • DATEN is an official representative;
  • DATEN is an authorized distributor;
  • there is a strategic alliance;
  • there is a corporate relationship;
  • there is a trademark license;

unless such relationship is expressly stated and can be substantiated.

10. Function of Trademarks Within the Catalog

Brands are displayed primarily to allow users to:

  • identify the manufacturer;
  • find products;
  • request quotes;
  • compare options;
  • identify models;
  • understand which product they wish to acquire.

The nominative use of a trademark to identify the corresponding product does not by itself imply that DATEN owns that trademark.

11. Genuine Products

DATEN's objective is to manage the acquisition of genuine products through suppliers, distributors, retailers or other legitimate commercial sources available in the United States.

The authenticity and specific conditions of each product will depend on the supplier and the corresponding transaction.

DATEN should not be interpreted as the manufacturer of products from the published brands.

12. Manufacturers and Trademark Owners

Products offered through DATEN are originally manufactured or marketed by their respective manufacturers, trademark owners or relevant suppliers.

The names, trademarks, logos and designs related to such products remain the property of their respective owners.

DATEN does not acquire ownership rights in a trademark merely by acquiring or marketing a legitimate product of that brand.

13. Product Photographs

Photographs displayed on the site may come from different sources, depending on the product.

They may include:

  • proprietary photographs;
  • photographs provided by suppliers;
  • authorized material;

When a supplier provides DATEN with:

  • images;
  • descriptions;
  • specifications;
  • logos;
  • material comercial;

DATEN may use them within the authorized scope to market or identify the corresponding products.

Authorization to use certain material does not mean that DATEN owns the rights to that material.

Technical specifications, model names, features and descriptions of certain products may come from:

  • manufacturers;
  • suppliers;
  • distribuidores;
  • fuentes comerciales;

  • software;
  • firmware;
  • aplicaciones;
  • licencias;
  • digital content;
  • online services.

These elements may be subject to separate license terms established by their respective owners.

A link to DATEN does not constitute authorization to use our trademark or commercial identity.

It is not permitted to use DATEN Global, DATEN, our logo or distinctive elements in a manner that could make a third party believe that it:

  • representa a DATEN;

  5. temporarily restrict the content when appropriate;
  6. remove the material when appropriate;
  7. request a license or authorization;
  8. determine that no infringement exists.

Submitting a claim does not automatically guarantee removal of the content.

  • ownership;
  • licencia;
  • authorization;
  • legitimate source.

When necessary, DATEN may temporarily remove the content while the situation is reviewed.

When a copyright claim is subject to U.S. law, DATEN may apply the corresponding procedures, including mechanisms established by federal copyright law where applicable.

The Digital Millennium Copyright Act (DMCA) establishes, among other things, notice-and-takedown mechanisms for certain content hosted online.

The specific application of such procedures will depend on the circumstances and applicable law.

33. Designated DMCA Agent

DATEN may designate and publish a specific agent to receive DMCA notices when appropriate.

Until such information is formally published on this page or on a specific page, intellectual property claims must be submitted through DATEN's official contact channels.

When a license requires the publication of certain attributions or notices, DATEN will seek to comply with those requirements.

If a legitimate intellectual property issue is identified, DATEN will evaluate the situation and may take the appropriate measures.
