Returns and Refunds Policy

1. Introduction
At DATEN Global, we manage the acquisition of specific products requested by our customers.
Unlike a traditional retail store that necessarily keeps all of its inventory available for return, many of our transactions involve acquiring a specific product specifically for a customer and then coordinating its international transportation and importation.
For this reason, cancellation, return and refund conditions depend primarily on the stage of each transaction.
This Policy explains:
- when a transaction may be canceled;
- when a refund may be requested;
- what happens when the product has already been purchased;
- what happens if the product is defective;
- what happens if the product arrives damaged;
- what happens if an incorrect product is received;
- how transportation problems are handled;
- how refunds are processed;
- what additional rights may apply to the customer under applicable law.
This Policy should be read together with our Terms and Conditions and our Shipping Policy.
2. General principle
The possibility of canceling a transaction depends primarily on whether DATEN has already acquired the product requested for the customer.
### Before the product is acquired
The customer may request cancellation of the transaction.
### After the product is acquired
Cancellation due to a change of mind may be limited because the product has been acquired specifically for that transaction.
However, this limitation does not eliminate rights the customer may have regarding:
- defective products;
- incorrect products;
- damage during transportation;
- breach of legal obligations;
- delays subject to cancellation rights;
- other situations protected by applicable law.
3. When can I cancel my order?
The customer may request cancellation while the product has not yet been acquired by DATEN.
The request must be submitted through the official customer service channels.
The cancellation will be evaluated based on the actual status of the transaction when DATEN receives the request.
4. Cancellation request
To request a cancellation, the customer should provide, when possible:
- name;
- email address;
- quote number;
- order number;
- contact information;
- reason for cancellation, when applicable.
DATEN will verify the status of the transaction before confirming whether the cancellation can be processed.
5. Cancellation before acquisition
If DATEN receives a cancellation request before acquiring the product, the transaction may be canceled.
When a refund is applicable, it will be processed in accordance with:
- the payment method used;
- the processor's terms;
- costs actually incurred that may legally apply;
- applicable law.
DATEN will not apply charges prohibited by applicable law.
6. What happens if I have already paid but DATEN has not yet purchased the product?
Payment by itself does not necessarily mean that the product has already been purchased.
If the customer requests cancellation and DATEN has not yet acquired the product, the transaction status will be verified.
When applicable, the refund will be processed in accordance with this Policy and applicable law.
7. What happens when DATEN has already purchased the product?
Once DATEN has specifically acquired the product for the customer, the possibility of canceling the transaction solely because of a change of mind may be limited.
This is because DATEN may have acquired a product specifically requested by the customer and incurred financial and logistical commitments toward third parties.
In these cases, any cancellation or return will depend on:
- supplier policy;
- nature of the product;
- possibility of return;
- status of the transaction;
- costs already incurred;
- transportation;
- export;
- import;
- applicable law.
Mandatory legal consumer rights remain in effect.
8. Can I cancel because I changed my mind?
If the product has not yet been acquired, you may request cancellation.
If the product has already been acquired specifically for you, cancellation because of a change of mind may not be available.
This is due to the customized nature of our international acquisition service.
However, this rule does not limit rights that applicable law may grant to consumers in certain circumstances.
9. Products acquired specifically for the customer
When DATEN acquires a product according to characteristics requested by the customer, the transaction may be considered a specific or made-to-order acquisition.
This may include products selected by:
- model;
- capacity;
- color;
- size;
- configuration;
- version;
- quantity;
- specific characteristics.
Because of this nature, the possibility of return due to a simple change of mind may be limited once the acquisition has been completed.
10. Can I change the product?
If the product has not yet been acquired, the customer may request a change.
DATEN may prepare a new quote if the change affects:
- price;
- availability;
- transportation;
- taxes;
- characteristics;
- logistics method.
If the product has already been acquired, the change will depend on the supplier's terms and the status of the transaction.
DATEN does not guarantee that an acquired product can be exchanged.
11. Customer error when selecting the product
The customer is responsible for carefully reviewing the information before confirming a purchase.
This includes:
- brand;
- model;
- version;
- capacity;
- color;
- size;
- configuration;
- quantity;
- compatibility;
- specifications.
If the customer confirms an incorrect product and DATEN acquires it according to the request submitted, any exchange or return will depend on the supplier's terms and applicable law.
12. Incorrect product sent by DATEN
If the customer receives a product different from the one requested in the confirmed quote, they must notify DATEN as soon as possible.
We recommend:
- do not use the product;
- keep the packaging;
- keep labels and documentation;
- take photographs;
- provide the order number;
- report the incident through the official channels.
DATEN will investigate the case and determine the appropriate actions.
13. Defective product
If the product has a defect that may be covered by a warranty or applicable legal rights, the customer must notify DATEN as soon as possible.
The case may be evaluated considering:
- nature of the defect;
- delivery date;
- condition of the product;
- available evidence;
- manufacturer;
- supplier;
- warranty;
- applicable law.
When applicable, DATEN may coordinate with the manufacturer, supplier or relevant operator.
14. Manufacturing defect
When there is a possible manufacturing defect, the solution may depend on the warranty provided by the manufacturer or supplier.
Depending on the product and case, the solution may include:
- repair;
- replacement;
- return;
- refund;
- technical service;
- another solution provided by the manufacturer or supplier.
DATEN may assist the customer in coordinating the process when possible.
15. Manufacturer warranties
The existence and scope of a warranty depend on the product, manufacturer, supplier, destination country and applicable terms.
A warranty offered by the manufacturer should not automatically be interpreted as a warranty directly provided by DATEN.
The procedure for using a warranty may require:
- proof of purchase;
- serial number;
- photographs;
- diagnosis;
- documentation;
- return shipment;
- inspection;
- communication with the manufacturer.
DATEN may guide the customer during the process when applicable.
16. International warranty
Not all manufacturers provide international warranty coverage for all products.
Coverage may depend on:
- model;
- country;
- region;
- distributor;
- serial number;
- purchase channel;
- manufacturer terms.
Before making a purchase, the customer may ask about warranty availability applicable to the product.
When international warranty is unavailable, the customer will be informed when that circumstance is known and relevant to the transaction.
17. Damage during transportation
If the product arrives with apparent damage caused during transportation, the customer must notify DATEN immediately.
We recommend:
- keep the packaging;
- photograph the exterior;
- photograph the interior;
- photograph the product;
- keep labels;
- keep documents;
- do not discard the packaging.
Evidence may be necessary to manage a claim with the logistics operator.
18. Visible damage at the time of delivery
If the package shows visible damage, the customer should document the condition of the package before opening it whenever reasonably possible.
If the operator allows a delivery observation to be recorded, we recommend doing so.
The absence of an observation does not automatically eliminate the customer's rights, but it may facilitate the investigation of a claim.
19. Damage claims
DATEN may coordinate the corresponding claim with the logistics operator.
The outcome will depend on:
- evidence;
- transportation conditions;
- coverage;
- operator investigation;
- circumstances of the damage;
- applicable law.
DATEN cannot guarantee the outcome of a claim against a third party.
20. Product lost during transportation
If an order does not arrive and there is evidence that the shipment is lost or cannot be located, DATEN may initiate or coordinate an investigation with the relevant operator.
The customer must provide the information necessary for the investigation.
The solution will depend on:
- status of the investigation;
- operator terms;
- coverage;
- documentation;
- circumstances of the case;
- applicable law.
When a refund or replacement is legally required, DATEN will comply with the applicable obligations.
21. Delivery delays
A delay does not automatically mean that the customer has the right to return the product.
However, when a delay gives rise to a cancellation or refund right under applicable law or the transaction terms, DATEN will honor that right.
For certain Internet sales subject to U.S. federal regulations, when DATEN cannot meet the applicable shipping deadline, it may be required to offer the customer the option to accept the delay or cancel the transaction and receive a refund.
22. Delays caused by customs
Customs processes may cause delays outside DATEN's direct control.
A delay may occur because of:
- inspection;
- documentation;
- classification;
- valuation;
- taxes;
- permits;
- controls;
- authority decisions;
- operator procedures.
DATEN will seek to provide information and coordination, but cannot control the decision time of a customs authority.
23. Product held by customs
If a product is held by authorities, DATEN may coordinate with the corresponding logistics operator and/or agent to determine what actions are necessary.
The outcome will depend on:
- laws of the country;
- nature of the product;
- documentation;
- importer's obligations;
- authority decision.
If the detention results from incorrect information or non-compliance attributable to the customer, the corresponding costs may be the customer's responsibility when legally applicable.
24. Product not authorized for import
If authorities determine that a product cannot be legally imported, DATEN may evaluate the available alternatives.
These may include:
- return to origin;
- cancellation;
- destruction;
- abandonment;
- re-export;
- another alternative permitted by the authorities.
Costs will depend on the cause of the situation, operator terms and applicable law.
DATEN does not guarantee that detained merchandise can be released.
25. Responsibility for incorrect customer information
If the customer provides incorrect information that affects the transaction, it may result in:
- delays;
- costs;
- return;
- customs problems;
- inability to deliver.
This may include incorrect information about:
- identity;
- address;
- telephone number;
- email;
- product;
- quantity;
- documentation;
- information required for importation.
When permitted by applicable law, costs directly resulting from incorrect information provided by the customer may be charged to the customer.
26. Refunds due to inability to acquire
If DATEN receives payment and subsequently cannot acquire the product under the confirmed conditions, DATEN will inform the customer.
Depending on the situation, it may:
- offer an alternative;
- prepare a new quote;
- cancel the transaction;
- process a refund when applicable.
The solution will depend on the reason for the inability and applicable law.
27. Refunds for cancellation before acquisition
When the customer has the right to cancel the transaction before DATEN acquires the product, the corresponding amount may be refunded.
The refund will be processed, whenever possible, using the same payment method used for the transaction.
If the original method does not allow the refund, DATEN may use another reasonable method in accordance with applicable law.
28. Refunds after acquisition
When the product has already been acquired, a refund is not automatically granted simply because it is requested.
The right to a refund will depend on:
- reason for the request;
- order status;
- supplier terms;
- possibility of return;
- damage;
- defects;
- breach;
- applicable law;
- specific transaction terms.
29. Refund for incorrect product
If DATEN determines that a product different from the one confirmed in the transaction was sent, an appropriate solution will be evaluated.
Depending on the case, this may include:
- replacement;
- return;
- refund;
- order correction;
- another reasonable solution.
The solution will be determined taking into account the nature of the error and applicable law.
30. Refund for defective product
If a product has a defect covered by a legal obligation, applicable warranty or specific commitment, the corresponding solution will be determined.
Depending on the case, it may include:
- repair;
- replacement;
- refund;
- credit;
- technical service.
Not all defects automatically result in a full refund.
31. Refund for damage during transportation
When transportation damage is confirmed and applicable coverage or liability exists, DATEN will coordinate the corresponding solution with the operator.
The solution may include:
- replacement;
- repair;
- refund;
- compensation;
- another available alternative.
The outcome will depend on the investigation and applicable terms.
32. How long does a refund take?
The time required to receive a refund depends on:
- payment method;
- entity that processed the payment;
- bank;
- processor;
- processing date;
- internal procedures.
DATEN will process applicable refunds within the time required by applicable law.
Once a refund has been issued, the time required for the funds to appear in the customer's account may depend on the bank or payment processor.
33. Refunds through Stripe
When payment was processed through Stripe, refunds may be processed through that provider when technically possible.
The crediting time will also depend on the payment method and the financial institutions involved.
Additional Stripe terms may apply to the technical processing of the refund.
34. Refunds through PayPal
When payment was made through PayPal, the refund may be processed through PayPal when applicable.
Availability and crediting time will depend on PayPal's terms and the related financial institution.
35. Refunds by bank transfer
When payment was made by bank transfer, DATEN may request the banking information necessary to process the refund.
The customer must provide correct information.
DATEN will not be responsible for delays or errors caused by incorrect banking information provided by the customer.
36. Processing fees and refunds
When a transaction is refunded, DATEN will determine the applicable amount based on:
- reason for the refund;
- applicable law;
- transaction terms;
- third-party costs;
- payment method.
DATEN will not deduct charges when applicable law requires a full refund.
When applicable law allows certain non-recoverable costs or they have been expressly accepted by the customer, they may be considered when determining the corresponding amount.
37. Taxes, duties and import charges
Taxes, duties, fees and import charges may depend on the destination country and the specific circumstances of the transaction.
If these amounts have already been paid to an authority, operator or third party, recovery may depend on:
- refund by the authority;
- operator terms;
- customs procedure;
- applicable law.
DATEN cannot guarantee that a tax or charge paid to a third party can be recovered.
38. Non-refundable transportation costs
If a transaction has already been dispatched and the customer subsequently requests cancellation for a reason that does not create a legal refund right, transportation costs already incurred may not be recoverable.
The possibility of passing on those costs will depend on:
- shipping status;
- operator terms;
- reason for cancellation;
- applicable law.
39. Non-refundable customs costs
Expenses generated before:
- authorities;
- agents;
- operators;
- warehouses;
- inspections;
- procedures;
may not be recoverable once incurred.
DATEN will inform the customer when these costs are relevant to the transaction.
40. Returns to suppliers are not made without prior evaluation
The customer must not send a product directly to a supplier, manufacturer or operator without prior instructions from DATEN.
An unauthorized return may:
- be lost;
- generate costs;
- fail to meet requirements;
- prevent recovery of the product.
Before making any return, the customer must obtain instructions from DATEN.
41. Procedure for requesting a return
When a return is appropriate, DATEN will provide instructions.
These may include:
- order identification;
- description of the problem;
- photographs;
- videos;
- serial number;
- documentation;
- packaging instructions;
- return address;
- transportation method;
- deadline for returning the product.
The customer must follow the instructions provided.
42. Condition of the product for return
When a return is authorized, the product must be kept in the condition indicated by DATEN, the supplier or the manufacturer.
Depending on the case, it may be necessary to keep:
- product;
- packaging;
- accessories;
- manuals;
- labels;
- documentation;
- serial number.
However, applicable legal rights will not be conditioned in a manner incompatible with mandatory law.
43. Used or modified products
When the customer has used, modified, installed or altered a product before reporting a defect or incident, the customer must disclose that circumstance.
Depending on the issue, such modification or use may affect the possibility of return or warranty when permitted by the applicable terms.
This provision does not limit legal rights available to the consumer.
44. Accessories and components
When a return is authorized, DATEN may request the return of:
- accessories;
- chargers;
- cables;
- manuals;
- components;
- packaging;
- documentation.
This will depend on the type of product and the applicable procedure.
45. Products that cannot easily be returned
Certain products may be subject to special return restrictions because of:
- nature of the product;
- hygiene;
- safety;
- software;
- activation;
- licenses;
- customization;
- manufacturer restrictions;
- international restrictions;
- law.
Before acquiring a product with special characteristics, DATEN may inform the customer of known limitations.
46. Customized or configured products
If a product has been configured or acquired specifically according to a particular customer request, the possibility of return due to a change of mind may be limited.
The situation will depend on:
- configuration;
- supplier;
- manufacturer;
- transaction status;
- applicable law.
47. Cancellation by DATEN
DATEN may cancel a transaction when there is a legitimate reason that prevents its execution, including:
- product unavailable;
- inability to acquire;
- export restrictions;
- import restrictions;
- inability to transport;
- fraud;
- payment problems;
- legal non-compliance;
- insufficient information;
- extraordinary circumstances.
When cancellation is attributable to DATEN and a refund right exists, the corresponding amount will be processed in accordance with this Policy and applicable law.
48. Cancellation due to inability to ship
If DATEN determines that it cannot complete the shipment within the applicable period or that the transaction cannot be carried out, the customer will be informed.
When applicable law requires offering the option to accept a delay or cancel and receive a refund, DATEN will comply with that obligation.
In particular, U.S. federal rules for Internet orders establish specific obligations when a seller cannot meet the announced shipping deadline or, if none was announced, the applicable legal deadline.
49. Refund for mandatory cancellation
When applicable law requires DATEN to cancel a transaction and issue a refund, DATEN will process the refund within the required time and using the required method.
For transactions subject to the U.S. federal Internet order rule, when a mandatory refund applies, the FTC establishes specific requirements regarding the timing and amount of the refund.
50. Customer does not appear to receive the order
If the customer is unavailable to receive the order, the operator may make additional delivery attempts, store the package or return it.
Return due to recipient absence does not automatically mean that DATEN must issue a full refund.
The following will be evaluated:
- reason;
- costs;
- shipping status;
- operator terms;
- applicable law.
51. Unjustified refusal of delivery
If the customer refuses an order that complies with the confirmed terms, DATEN may treat the matter as a delivery incident.
Return, storage or reshipping costs may be charged to the customer when applicable and permitted by applicable law.
This does not affect rights that apply when the refusal is due to a defect, incorrect product, damage or another legitimate reason.
52. Orders with multiple products
If an order contains several products, the possibility of canceling or refunding one of them may be evaluated independently.
When one part of the order can be delivered and another cannot, DATEN may:
- partially process the transaction;
- cancel the unavailable portion;
- issue a partial refund when applicable.
The solution will depend on the circumstances and applicable law.
53. Partial refunds
When only part of a transaction must be refunded, the amount will be calculated considering:
- affected products;
- applicable costs;
- amounts paid;
- transportation;
- taxes;
- third-party charges;
- applicable law.
No deductions prohibited by law will be made.
54. Credit or account balance
In certain situations, DATEN may offer a credit or account balance as an alternative to a refund when:
- the customer accepts it;
- the law permits it;
- the nature of the transaction permits it.
A credit will not replace a refund when applicable law expressly requires the return of money.
55. Replacements
When a replacement is applicable, DATEN may coordinate the acquisition or shipment of a new product.
The replacement will be subject to:
- availability;
- supplier;
- manufacturer;
- logistics;
- importation;
- applicable terms.
The customer may receive additional instructions for returning the original product when applicable.
56. Repairs
When the manufacturer or supplier determines that repair is the appropriate solution, DATEN may assist in coordinating the process.
Repair times will depend on the manufacturer, technical service, transportation and relevant country.
57. Refurbished, used or display products
Unless expressly stated otherwise, DATEN quotes correspond to new products.
If a product is:
- refurbished;
- used;
- a display unit;
- open box;
that condition must be disclosed before the transaction is confirmed.
58. Promotional or discounted products
Products acquired through promotions may be subject to specific terms.
A promotion does not eliminate mandatory legal consumer rights.
The particular terms of a promotion will be disclosed when applicable.
59. Products acquired through supplier offers
If the price of a product changes after DATEN has acquired the product, this does not automatically create a right to a refund of the difference.
The accepted quote corresponds to the economic terms confirmed for that transaction.
60. Price error
If DATEN detects an obvious error in a published or quoted price before completing a transaction, it may correct it and inform the customer of the situation.
If payment has already been received and DATEN cannot execute the transaction under the applicable terms, it may cancel the transaction and process the corresponding refund when applicable.
61. Fraud or unauthorized use of payment method
If there is a reasonable suspicion of:
- fraud;
- impersonation;
- unauthorized use of a card;
- improper use of an account;
- false documentation;
DATEN may temporarily suspend the transaction while conducting reasonable verification.
If a transaction is canceled for security or fraud reasons, the treatment of the funds will be determined according to:
- payment method;
- investigation result;
- processor instructions;
- applicable law.
62. Claims against third parties
When the issue is the responsibility of:
- manufacturer;
- supplier;
- logistics operator;
- payment processor;
- agent;
DATEN may assist the customer in coordinating the corresponding claim.
However, DATEN cannot guarantee the outcome of a claim against a third party.
The customer's rights against DATEN and rights against the relevant third party will be evaluated in accordance with applicable law.
63. Deadlines for reporting incidents
We recommend reporting any incident as soon as possible.
Especially in cases involving:
- damage;
- incorrect product;
- missing product;
- defect;
- loss;
- delivery problems.
Prompt communication facilitates the collection of evidence and the submission of claims to operators and suppliers.
Mandatory legal deadlines, warranties and consumer rights will prevail when applicable.
64. Evidence
DATEN may request:
- photographs;
- videos;
- proof of payment;
- screenshots;
- serial numbers;
- labels;
- documentation;
- operator reports.
Evidence will be used to investigate the incident and determine the appropriate solution.
65. Information provided in good faith
DATEN will seek to evaluate return and refund requests reasonably and in good faith.
The evaluation will take into account:
- information provided;
- order status;
- documentation;
- transaction terms;
- supplier terms;
- operator terms;
- applicable law.
66. Legal consumer rights
Nothing in this Policy is intended to exclude, limit or waive rights that consumers have under mandatory applicable law.
If a provision of this Policy is incompatible with an unwaivable legal consumer right, the applicable law will prevail with respect to that right.
67. Consumer protection in the United States
When a transaction is subject to U.S. federal law concerning Internet orders, DATEN will comply with applicable obligations relating to:
- shipping deadlines;
- delay notifications;
- cancellation;
- refunds;
- amounts that must be refunded.
The FTC states that when a seller cannot meet the applicable shipping deadline, it must offer consumers the options required by the regulations, including the possibility of canceling and receiving a refund under the circumstances provided.
68. Transactions destined for other countries
For transactions destined for other countries, consumer protection and e-commerce rules of the relevant country may apply when applicable.
DATEN will evaluate requests considering:
- applicable law;
- customer's residence;
- nature of the transaction;
- contracting entity;
- order status.
69. Taxes and refunds
Taxes and import charges may be collected by:
- authorities;
- operators;
- agents;
- suppliers.
When DATEN is not the party that directly collected a particular tax or charge, the possibility of obtaining a refund will depend on the third party or authority that received it and applicable law.
70. Bank transfer fees
When a refund is made by bank transfer, applicable bank fees will depend on the financial institutions involved.
DATEN will seek to issue the refund in accordance with applicable terms and will not apply deductions prohibited by law.
71. Refund currency
When the original payment was made in a particular currency, DATEN will seek to issue the refund in the same currency and using the same method when possible.
When this is not technically possible, the refund amount and method will be determined according to:
- payment provider;
- bank;
- transaction terms;
- applicable law.
Exchange-rate fluctuations may affect the amount received when conversion is performed by a financial institution.
72. Refund of third-party charges
Charges collected directly by third parties may be subject to their own policies.
DATEN cannot guarantee recovery of:
- bank fees;
- processor charges;
- taxes paid to authorities;
- operator fees;
- agent expenses;
- storage;
- special services.
When DATEN has a legal obligation to return an amount, it will comply with that obligation.
73. Fraudulent refund requests
DATEN may investigate requests showing reasonable indications of:
- fraud;
- abuse;
- manipulation;
- false documentation;
- inconsistent claims;
- misuse of the returns process.
This does not prevent a consumer from legitimately exercising their rights.
74. Return status updates
When a return is authorized, DATEN may provide statuses such as:

- refund approved;
- refund processed.
Statuses may vary depending on the transaction.
75. Relationship with the logistics operator
When a return requires international transportation, the terms of the relevant operator may apply.
The customer must follow the instructions provided for:

- labeling;
- documentation;
- handover to the carrier;
- tracking.
76. International returns
International returns may require:
- international transportation;
- documentation;
- customs procedures;
- declarations;
- taxes;
- permits.
Therefore, not all products can be physically returned to the supplier.
DATEN will evaluate each case before authorizing an international return.
77. Prohibition on sending returns without authorization
Do not send any product to:
- DATEN Global LLC;
- DATEN INC EIRL;
- manufacturer;
- supplier;
- distributor;
- logistics operator;
without first receiving official instructions from DATEN.
A return sent to an incorrect address may delay or prevent resolution of the case.
78. Return address
The return address will depend on the transaction.
It may be:
- supplier;
- logistics center;
- DATEN;
- agent;
- operator.
The applicable address will be provided only when the return has been authorized.
79. Exceptions
DATEN may establish specific conditions for certain products or transactions when there are:
- manufacturer restrictions;
- transportation restrictions;
- customs restrictions;
- legal requirements;
- special product characteristics;
- specific quote terms.
These conditions must be communicated to the customer when relevant.
80. Relationship with the Terms and Conditions
This Policy forms part of DATEN's contractual documentation.
It should be interpreted together with:

When a transaction has a specific term, that term may prevail for that transaction as long as it does not contradict an applicable legal obligation.
81. Changes to this Policy

- new logistics methods;
- changes in payment methods;
- process improvements.
The current version will be available on the website.
Changes will not retroactively affect rights or obligations that legally apply to transactions already confirmed.
